TERMS AND CONDITIONS
These Terms and Conditions (“Terms” or “Agreement”) govern your use of The Unbeatables Academy’s services, including website access, program licensing, facilitator certification, and all content provided (“the Site”, “the Service”, “Services”, “Us”, “We”, “Our”, “Company”, “Website”). By accessing or using our Site or purchasing our Services, you agree to be bound by these Terms.
Section 1 – Account Creation
You must create an account to access and use most Services. You agree to provide accurate and complete information and keep it updated. You are responsible for your account and activities associated with it. You must be at least 18 years old to use our Services.
Section 2 – Access to the Service and License
Upon purchase, organizations are granted a one (1) year non-exclusive, non-transferable license to access and deliver The Unbeatables Academy curriculum. Renewal is required annually. Delivery of The Unbeatables Academy program must be performed exclusively by certified Facilitators in good standing. Licensees may not sublicense, assign, delegate, or otherwise transfer the rights granted herein to any third party without the prior written consent of The Unbeatables Academy. Unauthorized use will result in immediate termination.
Section 3 – Facilitator Training, Certification, and Program Delivery Standards
3.1Mandatory Training and Certification
All instructors (“Facilitators”) must successfully complete The Unbeatables Academy Facilitator Training prior to delivering any portion of the program.
3.2Certification Validity
Facilitator Certification is valid for a period of two (2) years from the date of issuance.
Facilitators must renew their certification prior to expiration to continue delivering the program.
3.3Scope and Limitations of Certification
Certification grants permission solely to deliver The Unbeatables Academy curriculum.
Certified Facilitators may not deliver, represent, modify, sell, reproduce, adapt, or substitute any portion of the program for purposes outside the official framework established by The Unbeatables Academy.
3.4Program Integrity Standards
Facilitators must strictly adhere to the official methods, lesson structures, activities, and delivery standards established by The Unbeatables Academy.
No unauthorized alterations, omissions, additions, or substitutions are permitted.
3.5Authorized Use and Non-Transferability
Facilitator Certification is personal, non-transferable, and non-assignable.
Certified Facilitators are prohibited from training others or delegating the delivery of the program to uncertified individuals.
3.6Responsibility of Camp Owners and Program Administrators
Camp Owners or Program Administrators must ensure that only actively certified Facilitators deliver The Unbeatables Academy curriculum at their locations.
Camp Owners assume full responsibility for supervising their certified Facilitators’ adherence to program delivery standards.
3.7Monitoring, Compliance, and Quality Assurance
The Unbeatables Academy reserves the right to:
- Request proof of active Facilitator Certification at any time;
- Audit, observe, or monitor program delivery, either virtually or in person, to ensure compliance with The Unbeatables Academy standards.
3.8Independent Contractor Status
Certification does not create an employment relationship, agency, partnership, or joint venture with The Unbeatables Academy.
Certified Facilitators operate independently unless otherwise contracted in writing.
3.9Revocation of Certification
The Unbeatables Academy reserves the right to suspend or revoke Facilitator Certification, without refund or compensation, under any of the following circumstances:
(a) violation of program standards,
(b) unauthorized use, misrepresentation, or modification of the program,
(c) ethical misconduct, or
(d) reputational harm to The Unbeatables Academy.
3.10Educational and Legal Disclaimer
Certification by The Unbeatables Academy does not substitute for formal academic credentials or professional licenses.
Facilitators may not present themselves as licensed educators, therapists, counselors, or otherwise credentialed professionals unless separately qualified and licensed by appropriate regulatory authorities.
Section 4 – Usage Rules
You agree not to:
- Duplicate, modify, or distribute the Service or its content without prior written permission.
- Use certification to promote or deliver other educational programs.
- Misrepresent association with The Unbeatables Academy.
- Deliver The Unbeatables Academy program without maintaining active Facilitator Certification.
Section 5 – Marketing and Public Representation
Clients may announce the incorporation of The Unbeatables Academy program into their camps or schools.
All public announcements must reference “The Unbeatables Academy Life Skills Program.”
Clients must not claim ownership of the program.
Use of our logos, brand names, or official content in marketing materials requires prior written approval.
Clients may not modify The Unbeatables Academy logos, branding, or materials without express written consent.
Section 6 – Owner Responsibilities
The Owner is solely responsible for compliance with all terms outlined in this Agreement.
The Owner must ensure that all program delivery is conducted by certified Facilitators in compliance with The Unbeatables Academy standards.
Any breach by the Owner’s staff will be considered a breach by the Owner and will be subject to the same penalties.
Section 7 – Intellectual Property
All rights, title, and interest in the Service, platform, curriculum, branding, characters, and content remain the exclusive property of The Unbeatables Academy, Inc.
Licensees and Facilitators are granted no ownership rights and must cease all use upon termination of the Agreement.
Section 8 – Pricing and Payment Terms
Fees for licensing and certification are non-refundable.
Payment covers the one-year license and mandatory facilitator certification.
Renewal fees apply annually for continued access.
Annual license renewal is subject to The Unbeatables Academy’s review and approval.
The Academy reserves the right to deny renewal in cases of non-compliance, brand misrepresentation, or breach of any section of these Terms.
Late renewals or lapses in certification or licensing may be subject to additional reinstatement fees at The Academy’s discretion.
Section 9 – Termination for Breach
Violation of any of the terms outlined herein — including unauthorized use of content, delivery without certified staff, or misuse of the brand — will result in immediate termination of the license without refund.
In the event of termination, Licensees must immediately cease all use of The Unbeatables Academy intellectual property, branding, materials, and curriculum.
The Academy reserves the right to pursue legal remedies in cases of willful infringement.
Section 10 – Privacy and Data Protection
All personal information collected is governed by our Privacy Policy.
Section 11 – Third-Party Links
We are not responsible for the content, policies, or practices of any third-party websites linked through our Services.
Section 12 – Disclaimers and Limitations of Liability
Our Services are provided “as is” without warranty of any kind.
The Unbeatables Academy disclaims all liability to the fullest extent permitted by law.
Section 13 – Release and Indemnification
You agree to release and indemnify The Unbeatables Academy, Inc. from any and all claims, liabilities, damages, and expenses, including but not limited to those arising from improper program delivery, misuse of branding, violation of certification standards, or breach of these Terms.
Section 14 – Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Florida.
All disputes arising under these Terms shall be resolved exclusively through binding arbitration conducted in Miami-Dade County, Florida.
Section 15 – Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, such provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Section 16 – Entire Agreement
These Terms constitute the complete and exclusive agreement between you and The Unbeatables Academy regarding the Services, superseding all prior agreements or understandings.

Section 18 – Tangible Materials and Rewards Kits
Each participant enrolled in The Unbeatables Academy program must receive an official Rewards Kit.
The purchasing organization is responsible for ordering one (1) Rewards Kit per participant per season/program cycle.
Rewards Kits are mandatory to ensure consistency and quality of program delivery and participant experience.
Rewards Kits are proprietary to The Unbeatables Academy and may not be substituted, replicated, or manufactured independently.
